Hit and Run in a Parking Lot: What to Do When There's No Witness

Hit and Run in a Parking Lot: What to Do When There's No Witness

You return to your car and find a dent, a scrape, or a cracked bumper. No one around. No note under the wiper. Frustrating — but not hopeless.

Step 1: Document everything immediately

Before touching anything, take comprehensive photos and videos:

  • Full shots of the vehicle from all four angles to establish context.
  • Close-ups of the damage from different distances.
  • The surroundings: pillars, barriers, any visible CCTV cameras.
  • Your parking ticket with timestamp, if you have one.

This becomes the foundation of your insurance claim.

Step 2: Look for witnesses and CCTV footage

Witnesses: Ask shop staff, security guards, or parking attendants nearby. A parking attendant may have seen something.

CCTV footage: This is often decisive. Private car parks (supermarkets, shopping centres, hospitals) are required to respond to formal requests. Act immediately:

  1. Go to the parking operator or security office right away.
  2. Ask explicitly that footage be preserved — recordings are often overwritten within 24–72 hours.
  3. File a police report — this creates a legal framework to formally request the footage.

Step 3: File a police report

For any significant damage, file a police report. In France, failing to stop after causing an accident is a traffic offence (délit de fuite), punishable with a fine and licence points. The report legitimises your insurance claim and gives investigators grounds to access CCTV data.

Step 4: Notify your insurer

Report the claim within 5 working days (French legal requirement). Depending on your policy:

  • Comprehensive cover (tous risques): Covers your repairs minus the excess, even with no identified third party.
  • Third-party only: Does not cover your own damage if no responsible driver is identified.
  • Legal protection: Can help pursue the responsible party if they are identified on camera.

Step 5: If the responsible driver is identified

If CCTV captures the plate, give it to police with your report. Police can trace the owner through the vehicle registration system. You can then file a joint accident report if the other party cooperates, or let your insurer pursue their insurer.

Prevent the reverse situation
