Hit-and-Run on a Parked Car: Insurance, Claims and Compensation (2026)
You come back to a crushed bumper and a broken tail light — and no note under the wiper. The culprit is gone. It is one of the most frustrating claims there is: roughly one parking collision in two ends with the driver fleeing. Here is every recourse you have, in order.
Hit-and-run is a criminal offence — even for a scratch
Leaving the scene after a collision without providing your details is a hit-and-run (article 434-10 of the French Penal Code): up to 3 years in prison, a €75,000 fine, 6 licence points and up to a 5-year suspension. It applies even:
- for purely material damage;
- on a private car park (supermarket, residence) open to public traffic.
Step 1: freeze the evidence immediately
Before even moving your car:
- Photograph the damage close up and the scene wide (space, floor markings, neighbouring cars).
- Look for paint transfer from the other vehicle on your bodywork: its colour is a valuable clue.
- Note the date and time you found the damage, and roughly when you had parked.
Step 2: witnesses and cameras — a race against the clock
- Witnesses: shopkeepers, security guards, residents. Someone may have noted the fleeing car's plate — the ideal scenario, since their liability insurance would then pay 100% of your repairs.
- CCTV: most shopping centre car parks are filmed, but footage is erased within 30 days maximum. Only a judicial requisition — triggered by your police report — can retrieve it. Hence step 3, without delay.
- A witness note on your windshield: check the wipers and door handles carefully; kind witnesses do exist.
Step 3: file a police report
At the station or online (masecurite.fr for material damage in France). The report:
- triggers the CCTV review and the investigation;
- provides the receipt your insurer requires;
- formally documents the hit-and-run, which can matter for your deductible depending on the policy.
Step 4: notify your insurer within 5 working days
The clock starts when you discover the damage. Who pays what:
| Situation | Compensation |
|---|---|
| Driver identified (plate noted, CCTV) | Their liability insurance pays 100% — no deductible, no premium impact for you |
| Driver unknown + comprehensive / collision cover | Your insurer pays, minus the deductible; no bonus penalty once the hit-and-run is documented |
| Driver unknown + third-party only | No insurance payout |
France's guarantee fund (FGAO) only covers material damage when the culprit is identified but uninsured, or when there are injuries: for a car hit by a stranger who is never found, it will not pay.
Put the odds on your side for next time
- Dashcam with parking mode: it films the impact and the fleeing plate, even with the engine off.
- Choose your spots: away from trolleys, near cameras, reversed against a wall.
- A contact QR code on the windshield: a witness who saw everything can message you on the spot — photo and plate included — via a QR code like Klaxie, instead of a paper note that blows away with the first shower. And if you ever bump a car yourself, the other driver's QR lets you own up in 30 seconds without exposing your number.
Your car sleeps outside? With Klaxie, a witness can alert you in 30 seconds — collision, the culprit's plate, photo attached. Free, anonymous, 2-minute setup.
